Rule 43: Standard Mutual Temporary Restraining Orders

  1. Upon the filing in this court of any complaint for divorce, legal separation or annulment, the Plaintiff shall prepare and sign a proposed mutual temporary restraining order, found below under (C) and present it at the time of filing the complaint. The Plaintiff, by virtue of initially filing the complaint in this court, shall be deemed to be aware of and acquiesce to the provisions of the restraining order. Plaintiff shall serve the Defendant with a copy of the restraining order.
  2. A party against whom a standard restraining order has been granted, may file a motion to modify or vacate the Standard Mutual Temporary Restraining Order. The motion shall contain a notice of hearing and both shall be served on the other party in accordance with the Ohio Civil Rules. If the relief sought relates to paragraph 11 of the below form order, the court shall provide a priority hearing date.

This is an official Court Order. If you disobey any order of the court, you may be found in contempt of Court, sentenced to jail, fined, and ordered to pay costs and attorney fees in addition to any other legal remedy available to the spouse, child(ren) or other dependent(s) affected. This order is in effect until (1) the Court issues an order, that modifies or vacates it, or (2) a judgment for divorce, legal separation or annulment is filed with the Clerk of Courts.
