Rule 50: Termination of Community Control Supervision
Upon the filing of a Notice of Recommendation for Termination of Community Control Supervision by the Juvenile Community Enrichment Services (“JCES”) Department, the Franklin County Prosecutor is notified that it has fourteen (14) calendar days from the date of filing to submit a written objection. Any objection must be filed no later than 5:00 p.m. on the fourteenth (14th) calendar day following the filing of the Notice. Objections filed after 5:00 p.m. on the fourteenth (14th) day shall be considered untimely. Beginning on the fifteenth (15th) calendar day following the filing of the Notice, and in the absence of a timely objection, JCES may file an Entry Terminating Community Control Supervision for the Judge’s signature.
If a timely objection is filed, the matter will be set for a hearing before the assigned Magistrate to determine whether termination of Community Control Supervision is appropriate. If no timely objection is filed by 5:00 p.m. on the fourteenth (14th) calendar day, no further action is required by the Prosecutor, and the Court shall approve and adopt the JCES Department’s recommendation to terminate Community Control Supervision, unless circumstances arise after the filing of the Notice that make the termination inappropriate as determined by the Judge or JCES staff.
