Preferences and Practices
Please be prepared to proceed on the date of your trial or hearing. If a continuance is requested, please contact each party/attorney and attempt to resolve any issues PRIOR to requesting the continuance from the court.
Professionalism and Civility
Professionalism, preparedness and civility are expected of all parties and counsel. I expect courtesy to all counsel, parties and court personnel.
Temporary Orders
I like to have an actual status conference with parties/attorneys to discuss the issues and possible resolutions PRIOR to obtaining a date for supplemental affidavits.
Rule 75 Hearings
Rule 75 hearings are conducted on additional affidavits, with each party having the opportunity to present a 10 minute appellate style argument. I reserve the right to swear in the parties and ask questions that I may have after reviewing the affidavits and listening to the oral presentation.
Courtroom Procedure
All cases will be set at a specific time and there may be multiple cases scheduled at the same time. Failure to appear for your case on time (being more than 5 minutes late) may result in a continuance, dismissal of the case, or the case proceeding without you.
At each hearing, you/your attorney should be prepared to inform the court of: all efforts that have been made to settle the case since the last court date.
Finally, you and your attorney should be prepared at all times to begin trial. The magistrate reserves the right to begin trial on any scheduled court date and all scheduled court dates should be considered trial dates unless specifically informed otherwise by the magistrate.
Mediation
All cases, unless approved by the magistrate, will be required to participate in some form of mediation. This may include mediation services through the court, privately retained mediations sessions, or settlement conferences hosted by the magistrate. This requirement shall be court ordered and a failure to follow the court orders will carry the same potential sanctions as a failure to follow any other court order.
General
My writing day is Wednesday.
- Please be mindful of whether your case/motion is delinquent. I expect timeliness in the disposition of all cases.
- I am happy to meet with all parties/counsel anytime that I am available to assist in resolving issues.
- Please DO NOT attempt to discuss the substance of a case with me unless ALL parties or their attorneys are present.
- Cases/motions are subject to immediate DISMISSAL if Entries are not submitted prior to the designated deadline.
- Trials will not be conducted by Zoom.
